YOUR ACCOUNT / MEMBERSHIP
Use of the Site is available only to persons who can form legally binding contracts under applicable law. Users who are "incompetent to contract" within the meaning of the Indian Contract Act, 1872 including un-discharged insolvents etc. are not eligible to use the Site. Suneet Varma reserves the right to terminate your membership and refuse to provide you with access to the Site if Suneet Varma discovers that you are under the age of 18 years. Those whose membership has been suspended or terminated by www.suneetvarma.in for whatever reason are not permitted to use the site. If you are registering as a business entity, you represent that you have the authority to bind the entity to this User Agreement.
Except where additional terms and conditions are provided which are product specific, these terms and conditions supersede all previous representations, understandings, or agreements and shall prevail notwithstanding any variance with any other terms of any order submitted. By using the services of Suneet Varma, you agree to be bound by the Terms and Conditions.
REVIEWS, COMMENTS, COMMUNICATIONS, AND OTHER CONTENT
Visitors may post reviews, comments, and other content and communications; and submit suggestions, ideas, comments, questions, or other information, so long as the content is not illegal, obscene, threatening, defamatory, invasive of privacy, infringing of intellectual property rights, or otherwise injurious to third parties or objectionable and does not consist of or contain software viruses, political campaigning, commercial solicitation, chain letters, mass mailings, or any form of spam.
You may not use a false email address, impersonate any person or entity, or otherwise mislead as to the origin of a card or other content. Suneetvarma.in reserves the right (but not the obligation) to remove or edit such content, but does not regularly review posted content.
If you do post content or submit material, and unless we indicate otherwise, you grant Suneetvarma.in and its affiliates a nonexclusive, royalty-free, perpetual, irrevocable, and fully sub licensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content throughout the world in any media.

RISK OF LOSS
All items purchased from suneetvarma.in are made pursuant to a shipment contract. This means that the risk of loss and title for such items pass to you upon our delivery to the carrier.
PRODUCT DESCRIPTIONS
Suneetvarma.in and its affiliates attempt to be as accurate as possible. However, suneetvarma.in does not warrant that product descriptions or other content of this site is accurate, complete, reliable, current, or error-free.
If a product offered by suneetvarma.in itself is not as described, your sole remedy is to return it in unused condition.
PRICING
Except where noted otherwise, the List Price displayed for products on our website, whether in Foreign Currency or Indian Rupees represents the full price of the product.
With respect to items sold on suneetvarma.in, we charge your credit card before your order has entered the shipping process. For any reason if we are not able to ship you products as per your order, we will intimate you electronically and refund the value of the products not available. Any additional Shipping Fees, if applicable, will not be refunded.
Despite our best efforts, a small number of the items in our catalog may be mispriced. If we discover a mispricing, we will do one of the following:
If an item correct price is lower than our stated price, we will charge the lower amount and ship you the item.
If an item correct price is higher than our stated price, we will, at our discretion, either contact you for instructions before shipping or cancel your order and notify you of such cancellation
Please note that this policy applies only to products sold and shipped by Suneetvarma.in. The prices displayed on this site are quoted in Indian Rupees with approx. conversion rate in US Dollars. The actual amount to be paid by you will be the equivalent amount in the currency of your credit card, as per the conversions done by your bank / credit card provider on the date of billing.
SHIPPING
We offer free shipping for all orders in India. The estimated delivery time will differ with each order. Typically, we take around 10 business days to dispatch orders within India, business days to dispatch international orders for our SV Muse ready-to-wear lines by Suneet Varma.
Suneet Varma SV Couture is made-to-order and takes 7- 8 weeks for production and dispatch, depending on the garment’s design and style.
Delivery within India takes 2-4 business days and internationally takes 8-10 business days depending on the location and custom clearance in the destination country. Sometimes, delivery time is subject to factors beyond our control, including but not limited to, unexpected travel delays from our courier partners due to weather conditions or any political disruptions or strikes. We promise to keep you updated at every step.
Order collection from any of Suneet Varma retail outlets can be done upon request. Please contact our customer care for further assistance at customercare@suneetvarma.in.
DUTIES AND TAXES
All of Suneet Varma orders are shipped Internationally from our warehouse in Noida, India to your provided shipping address. Customers are responsible for any import duties, custom fees, or local taxes that may apply to their purchase. Suneet Varma does not take any responsibility for non-delivery of orders in case such taxes and duties are not accepted and settled by the recipient at the delivery address, and will not provide any refunds in such cases.
EXCHANGES, RETURN & REFUNDS
We want you to love what you purchase, but if something isn’t right do let us know. In the unlikely event that something you ordered from suneetvarma.in is damaged or defective, you may return the product as we offer free returns. Please contact us on customercare@suneetvarma.in and ensure the product is unused and in the same condition as you received it with original invoice, and preferably in its original packaging and price tags.
A refund is offered only on merchandise sold at maximum retail price, without any discount. Merchandise bought on discount is considered as final sale, and hence is not eligible for refund or exchange.
Please note, SV Couture is 100% hand embroidered and handmade product so we do not accept returns for made-to-order items and accessories.

In special cases, a refund is provided irrespective of the discount when:
- The order is cancelled prior to dispatch due to unavailability.
- The product is returned due to a quality defect or damage during transit.
- The refund amount is credited to your initial payment account within 7 working days.
- In the case of a cash purchase, you are required to provide your account details to process the refund.

INTERNATIONAL RETURNS
We do not offer merchandise exchanges and/or returns on orders shipped internationally. In the unlikely event that any merchandise you have ordered from us is not received in good condition, is damaged or defective, or if merchandise delivered is different from what you had expected, kindly reach out to us at customercare@suneetvarma.in within 24 hours of receiving the order.
CANCELLATION BY SUNEET VARMA
Please note that there may be certain orders that we are unable to accept and must cancel. We reserve the right, at our sole discretion, to refuse or cancel any order for any reason. Some situations that may result in your order being canceled include limitations on quantities available for purchase, inaccuracies or errors in product or pricing information, or problems identified by our credit and fraud avoidance department. We may also require additional verifications or information before accepting any order. We will contact you if all or any portion of your order is canceled or if additional information is required to accept your order. If your order is cancelled after your credit card has been charged, the said amount will be reversed back in your Card Account.
CREDIT CARD DETAILS
You understand, acknowledge and confirm that the credit card details provided by you for availing of services on Suneet Varma will be correct and accurate and you shall not use the credit card which is not lawfully owned by you, i.e. in a credit card transaction, you must use your own credit card. You further agree and undertake to provide the correct and valid credit card details when making payment on Suneet Varma. Your credit card information never reaches Suneet Varma, we just get pass, hold or fail message from our payment gateways. Our payment gateways and Suneet Varma will not use or share the aforementioned information with any third parties unless it is necessary for fraud verifications or as required by law, regulation or court order. Suneet Varma will not be liable for any credit card fraud. The liability for use of a card fraudulently will be on you and the onus to 'prove otherwise' shall be exclusively on you.

FRAUDULENT /DECLINED TRANSACTIONS
Suneet Varma reserves the right to recover the cost of products, collection charges and lawyers’ fees from persons using the Site fraudulently. Suneet Varma reserves the right to initiate legal proceedings against such persons for fraudulent use of the Site and any other unlawful acts or acts or omissions in breach of these terms and conditions.
We as a merchant shall be under no liability whatsoever in respect of any loss or damage arising directly or indirectly out of the decline of authorization for any Transaction, on Account of the Cardholder having exceeded the preset limit mutually agreed by us with our acquiring bank from time to time.
SIZING
The fit of our clothing depends on the cut, fabric and style of each garment. Some garments are designed to have a looser, relaxed fit and some garments are styled to be more fitted. Please review our sizing guide to select the size best suited to you.
COLOURS
We have done our best to display as accurately as possible the colors of the products shown on suneetvarma.in. However, because the colors you see will depend on your device and monitor, we cannot guarantee that your monitor display of any color will be accurate. Color may vary on the website from actual Color of the product depending on your device’s screen properties and settings.
DISCLAIMER OF WARRANTIES AND LIMITATION OF LIABILITY
This site is provided by suneetvarma.in on an as is and as available basis. Suneetvarma.in makes no representations or warranties of any kind, express or implied, as to the operation of this site or the information, content, materials, or products included on this site. You expressly agree that your use of this site is at your sole risk.
To the full extent permissible by applicable law, Suneetvarma.in disclaims all warranties, express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose. Suneetvarma.in does not warrant that this site, its servers, or email sent from Suneetvarma.in are free of viruses or other harmful components. Suneetvarma.in will not be liable for any damages of any kind arising from the use of this site, including, but not limited to direct, indirect, incidental, punitive, and consequential damages.

INDEMNITY
You agree to defend, indemnify and hold harmless Suneet Varma Design Private Limited, its employees, directors, officers, agents and their successors and assigns from and against any and all claims, liabilities, damages, losses, costs and expenses, including attorney's fees, caused by or arising out of claims based upon your actions or inactions, which may result in any loss or liability to Suneet Varma Design Private Limited or any third party including but not limited to breach of any warranties, representations or undertakings or in relation to the non-fulfillment of any of your obligations under this User Agreement or arising out of the your violation of any applicable laws, regulations including but not limited to Intellectual Property Rights, payment of statutory dues and taxes, claim of libel, defamation, violation of rights of privacy or publicity, loss of service by other subscribers and infringement of intellectual property or other rights. This clause shall survive the expiry or termination of this User Agreement.
GOVERNING LAW AND JURISDICTION
This User Agreement shall be construed in accord with the applicable laws of India. The Courts at Delhi shall have exclusive jurisdiction in any proceedings arising out of this agreement.
Any dispute or difference either in interpretation or otherwise, of any terms of this User Agreement between the parties hereto, the same shall be referred to an independent arbitrator who will be appointed by Suneet Varma and his decision shall be final and binding on the parties hereto. The above arbitration shall be in accordance with the Arbitration and Conciliation Act, 1996 as amended time to time. The arbitration shall be held in Delhi. The High Court of judicature at Delhi alone shall have the jurisdiction and the Laws of India shall apply.
FORCE MAJEURE
Suneet Varma cannot be held liable for failure to fulfill one of its commitments to the Customer, if this failure is due to a case of force majeure such as natural disaster, war, strike (in-house or at one of its service providers), lock-out, accident, fire, ice, flood, bad weather, interruption or suspension of means of communication and/or transport, blockage of exports, prohibited import or export, cessation of production or delivery, regulatory decision of an administrative supervisory body, etc.
TERMINATION
This User Agreement is effective unless and until terminated by either you or Suneet Varma. You may terminate this User Agreement at any time, provided that you discontinue any further use of this Site. Suneet Varma may terminate this User Agreement at any time and may do so immediately without notice, and accordingly deny you access to the Site, such termination will be without any liability to Suneet Varma. Upon any termination of the User Agreement by either you or Suneet Varma, you must promptly destroy all materials downloaded or otherwise obtained from this Site, as well as all copies of such materials, whether made under the User Agreement or otherwise. Suneet Varma’s right to any Comments shall survive any termination of this User Agreement. Any such termination of the User Agreement shall not cancel your obligation to pay for the product already ordered from the Site or affect any liability that may have arisen under the User Agreement.
DISPUTES
Any dispute relating in any way to your visit to suneetvarma.in or to products you purchase through suneetvarma.in shall be submitted to confidential arbitration in Delhi, India, except that, to the extent you have in any manner violated or threatened to violate suneetvarma.in intellectual property rights, suneetvarma.in may seek injunctive or other appropriate relief in any court in India or internationally, and you consent to exclusive jurisdiction and venue in such courts. Arbitration under this agreement shall be conducted under the rules then prevailing under the Indian Arbitration Act.
The arbitrator award shall be binding and may be entered as a judgment in any court of competent jurisdiction. To the fullest extent permitted by applicable law, no arbitration under this Agreement shall be joined to an arbitration involving any other party subject to this Agreement, whether through class arbitration proceedings or otherwise.
SITE POLICIES, MODIFICATION AND SEVERABILITY

We reserve the right to make changes to our site, policies, and these Terms of Use at any time. If any of these conditions shall be deemed invalid, void, or for any reason unenforceable, that condition shall be deemed severable and shall not affect the validity and enforceability of any remaining condition.
